TERMENI SI CONDIȚII INTRODUCERE   Compania care administreaza site-ul www.chaletbyprovence.ro este SC Center Care Suceava SRL, cu sediul social in Suceava, strada Cenăuți 75A, Jud. Suceava, avand codul unic de inregistrare RO 30355528 si fiind inregistrata la Registrul Comertului sub nr. J33/492/2012, denumita in continuare “Pensiunea Chalet by Provence Suceava”. TERMENII SI CONDITIILE de mai jos se vor aplica tuturor rezervarilor si serviciilor oferite de Pensiunea Chalet by Provence Suceava, indiferent cum au fost obtinute (prin site-ul propriu: www.chaletbyprovence.ro, e-mail: chaletsuceava@gmail.com sau telefonic: +40742490025), denumite in continuare “rezervari” sau “servicii”. Termenii “Tu” si “Utilizator” sunt utilizati aici pentru a se referi la toate persoanele si/sau entitatile care, din orice motiv, acceseaza si utilizeaza serviciile site-ului www.chaletbyprovence.ro, denumit in continuare “Site-ul”. „Acordul” inseamna confirmarea ofertei de rezervare impreuna cu acesti termeni si conditii. „Oaspete” inseamna persoana ce urmeaza a fi/sau care este deja cazata in hotel. Prin folosirea, vizionarea, transmiterea, retinerea, stocarea si/sau utilizarea site-ului, a serviciilor sau a functiilor oferite in sau de site, sau a continutului site-ului, in orice modalitate, Utilizatorul este de acord cu fiecare dintre termenii si conditiile prezentate in continuare. Ne rezervam dreptul, la unica si absoluta noastra discretie, sa schimbam, sa modificam, sa adaugam sau sa stergem parti ale acestor TERMENI SI CONDITII in orice moment, fara nici o notificare, si, in masura in care nu se prevede altfel, aceste modificari vor deveni efective imediat. Ca atare, Utilizatorul este rugat sa verifice periodic schimbarile in acesti TERMENI SI CONDITII. Continuarea folosirii site-ului dupa efectuarea modificarilor, va insemna ca Utilizatorul accepta aceste modificari. EFECTUAREA UNEI REZERVARI Pentru a efectua o rezervare, va rugam sa completati formularul de pe site-ul propriu www.chaletbyprovence.ro, sa apelati numarul de telefon +40742490025 sau sa ne contactati pe adresa de e-mail chaletsuceava@gmail.com Site-ul este disponibil doar pentru persoane fizice sau juridice care pot incheia contracte valabile in conformitate cu legislatia aplicabila. In mod nelimitat site-ul si serviciile oferite de site nu sunt disponibile pentru minori. La solicitarea scrisa pe e-mail a unui potential oaspete al pensiunii nostru, vom depune toate diligentele pentru a-i da posibilitatea sa beneficieze de serviciile pensiunii. Solicitantul va primi raspunsul tot pe e-mail, intr-un interval de maxim 48 de ore. Pozele listate pe paginile de prezentare ale camerelor pensiunii sunt cu titlu informativ si nu reprezinta în totalitate stilul camerei rezervate. Pensiunea isi rezerva dreptul de a alege pentru dumneavoastra etajul, pozitia precum si stilul (decorul) camerei in functie de disponibilitatea de la data sosirii dumneavoastra. MODALITATI DE PLATA Dupa primirea acordului dumneavoastra privind oferta de rezervare, veti primi pe e-mail factura aferenta impreuna cu link-ul de plata, care trebuie platita integral, in termen de 24 de ore, prin ordin de plata sau online cu cardul bancar. Plata online cu cardul se realizeaza prin intermediul unui link securizat de plata. Accesati link-ul unde veti gasi suma de plata care ati stabilit ca doriti sa o platiti. Completati campurile cu datele cardului dvs. si autorizati plata. Sub nici o forma nici una din datele sau informatiile cu privire la cardul dvs nu ajung in posesia SC Center Care Suceava SRL si nici nu sunt stocate pe server-ele noastre. ANULAREA/MODIFICAREA UNEI REZERVARI Pentru a efectua o anulare sau o modificare a unei rezervari, va rugam sa ne contactati la adresa noastra de e-mail office@hotels-eden.ro. Pentru anularile/ modificarile efectuate cu pana la 48 de ore inainte de data sosirii nu se percepe nici o taxa suplimentara. Anularea/ modificarea rezervarii dupa acest termen sau neprezentarea la cazare (ora 14:00) fara a anunta in prealabil despre intarziere (se poate intarzia pana la ora 18:00 dar trebuie anuntata), atrage dupa sine o taxa de anulare/no-show, reprezentand contravaloarea primei nopti de cazare. Tarifele survenite in urma modificarilor pot varia, in functie de natura schimbarii, cat si de disponibilitatea in momentul modificarii aduse rezervarilor. RETURNAREA SUMELOR PLATITE Daca rezervarea este anulata sau modificata cu pana la 48 de ore inainte de data sosirii, suma achitata va fi returnata integral. Daca rezervarea este anulata sau modificata mai tarziu sau in caz de neprezentare fara a anunta in prealabil despre intarziere, suma achitata va fi returnata partial, mai putin contravaloarea primei nopti de cazare. Sumele vor fi returnate in contul mentionat de dumneavoastra in mail-ul trimis la adresa noastra de e-mail office@hotels-eden.ro, in termen de maxim 15 zile de la primirea acestuia, cu exceptia platilor online in care retunarea se va face pe contul de card din care s-a incasat initial. LINKURI CATRE SITE-URI ALE UNOR TERTE PARTI Site-ul www.chaletbyprovence.ro poate permite linkuri catre site-uri sau aplicatii care pot fi sau nu pot fi afiliate noua. Toate aceste link-uri si aplicatii, incluzand dar nu limitandu-se la cele ale unor furnizori de continut, comercianti, francizori, parteneri de afaceri, denumiti in continuare “Furnizori”, au termeni si conditii diferite de cele de fata. Accesarea si utilizarea unor astfel de link-uri catre terte site-uri sau aplicatii si orice corespondenta sau tranzactii ati dezvolta utilizandu-le, sunt guvernate nu de catre ACESTI TERMENI SI CONDITII, ci de catre TERMENII SI CONDITIILE ACELOR site-uri sau aplicatii. Noi va punem la dispozitie link-uri catre terte site-uri si aplicatii numai in folosul sau pentru informarea dumneavastra, iar utilizarea acestora se face pe propriul dumneavoastra risc. PROTECTIA DATELOR PERSONALE ALE UTILIZATORULUI Utilizatorii serviciilor de rezervare pe e-mail, oferite prin www.chaletbyprovence.ro, ofera date cu caracter personal, denumite in continuare “datele personale”, si accepta in mod expres, pe deplin si fara rezerve ca Pensiunea Chalet by Provence Suceava, le poate prelucra datele intr-un mod automat si le poate utiliza in anumite studii pentru a isi imbunatatii si oferii serviciile. Persoanele ale caror date cu caracter personal le prelucram au urmatoarele drepturi: – dreptul la rectificare – dreptul la stergerea datelor – dreptul de “a fi uitat” – dreptul la restrictionarea prelucrarii – dreptul la portabilitatea datelor – dreptul la opozitie – dreptul de a nu fi supus unei decizii individuale – dreptul de a se adresa justitiei sau autoritatii nationale de supraveghere a prelucrarii datelor cu caracter personal In acest scop, va fi suficient sa contactati Pensiunea Chalet by Provence Suceava pe adresa de e-mail chaletsuceava@gmail.com sau in scris la adresa punctul de lucru unde este situat hotelul: Str. In plus, Pensiunea Chalet by Provence Suceava garanteaza confidentialitatea datelor cu caracter personal, desi va comunica autoritatilor publice competente datele cu caracter personal si orice alte informatii aflate in posesia sa sau accesibile prin intermediul sistemelor sale care ar putea fi solicitate in conformitate cu dispozitiile legale si de reglementare aplicabile daca e cazul. Utilizatorii site-ului www.chaletbyprovence.ro garanteaza si sunt responsabili pentru veridicitatea, acuratetea, validitatea si autenticitatea datelor cu caracter personal furnizate si se angajeaza sa le pastreze in mod corespunzator. Acest site si continutul prezentat in acest site, nu poate fi copiat, reprodus, republicat, incarcat, postat, modificat, transmis sau distribuit fara permisiunea detinatorului legal, cu exceptia faptului ca Utilizatorul poate descarca, prezenta sau imprima o copie a materialelor prezentate in acest site folosind un singur calculator, exclusiv pentru folosinta proprie necomerciala. Folosirea neautorizata a acestui site si/sau a materialelor continute in acest site poate incalca legea copyrightului, a marcilor comerciale, legile privind proprietatea intelectuala sau alte legi. Folosirea acestor materiale pe orice alt web site sau in orice alta retea computerizata este interzisa. POLITICA DE COOKIE Pensiunea Chalet by Provence Suceava poate utiliza cookie-uri atunci cand utilizatorul navigheaza pe acest site. Aceste cookie-uri pot fi activate de Pensiunea Chalet by Provence Suceava sau de catre o terta parte contractata de catre Pensiunea Chalet by Provence Suceava pentru servicii de masurare si evaluare. Utilizatorul este de acord ca Partile nu sunt responsabile in orice mod pentru ranirea, pierderea sau prejudicierea calculatorului sau a datelor, documentelor informatiilor din calculatorul Utilizatorului sau pentru interceptarea sau folosirea informatiilor de pe cardul de credit, legat de sau rezultand din folosirea site-ului sau a oricaror site-uri, servicii sau materiale legate sau conectate si de asemenea nu sunt raspunzatoare in nici un fel pentru ranirea, pierderea, reclamatia sau prejudicierea legata de sau rezultand din orice parte a site-ului care opereaza sau nu opereaza pe calculatoare sau pe retele folosite de Utilizator sau comunicand cu asemenea calculatoare sau retele. Site-ul poate sa contina incorectitudini tehnice sau greseli ori omisiuni tipografice. Pensiunea Chalet by Provence Suceava nu este raspunzatoare pentru nici o eroare de natura tipografica, fotografica, tehnica sau legata de preturi (incluzand, dar fara limitare la preturi gresite ale hotelurilor) care apar listate pe site-ul nostru. Pensiunea Chalet by Provence Suceava isi rezerva dreptul de a face modificari, corectii si/sau imbunatatiri ale site-ului si ale produselor sau programelor descrise in astfel de informatii, in orice moment, fara vreo notificare. Ne rezervam dreptul de a anula sau de a modifica rezervari atunci cand se dovedeste ca un client este angajat in activitati frauduloase sau nepotrivite sau in circumstante din care reiese ca rezervarea contine sau rezulta dintr-o greseala sau dintr-o eroare. LEGEA APLICABILA SI LITIGII   Drepturile si obligațiile partilor prevazute de acesti TERMENI SI CONDITII, precum si toate efectele juridice pe care le produc, vor fi interpretate si guvernate in conformitate cu legislatia romana in vigoare. The terms "You" and "User" are used here to refer to all persons and/or entities who, for any reason, access and use the services of the website www.chaletbyprovence.ro, hereinafter referred to as the "Site". "Agreement" means the confirmation of the reservation offer together with these terms and conditions. "Guest" means the person who is to be/or who is already accommodated in the hotel. By using, viewing, transmitting, retaining, storing and/or utilizing the site, the services or functions offered on or by the site, or the content of the site, in any way, the User agrees to each of the terms and conditions presented below. We reserve the right, at our sole and absolute discretion, to change, modify, add or delete portions of these TERMS AND CONDITIONS at any time, without notice, and, unless otherwise stated, such changes shall be effective immediately. Accordingly, the User is advised to periodically review these TERMS AND CONDITIONS for any changes. Your continued use of the Site after any changes have been made will constitute your acceptance of such changes. MAKING A RESERVATION To make a reservation, please fill out the form on our website www.chaletbyprovence.ro, call the phone number +40742490025 or contact us at the e-mail address chaletsuceava@gmail.com The site is available only to natural or legal persons who can enter into valid contracts in accordance with applicable law. Without limitation, the site and the services offered by the site are not available to minors. Upon written request by e-mail from a potential guest of our guesthouse, we will do our utmost to give him the opportunity to benefit from the guesthouse's services. The applicant will receive a response also by e-mail, within a maximum of 48 hours. The pictures listed on the guest house's room presentation pages are for informational purposes only and do not fully represent the style of the room you have booked. The guest house reserves the right to choose the floor, position and style (decor) of the room for you, depending on availability on the date of your arrival. PAYMENT METHODS After receiving your agreement regarding the reservation offer, you will receive the related invoice by e-mail along with the payment link, which must be paid in full, within 24 hours, by payment order or online with a bank card. Online payment by card is made through a secure payment link. Access the link where you will find the payment amount you have determined you want to pay. Fill in the fields with your card details and authorize the payment. Under no circumstances does any of the data or information regarding your card come into the possession of SC Center Care Suceava SRL nor is it stored on our servers. CANCELLING/CHANGING A RESERVATION To cancel or modify a reservation, please contact us at our email address office@hotels-eden.ro. For cancellations/modifications made up to 48 hours before the arrival date, no additional fee will be charged. Cancellation/modification of the reservation after this deadline or failure to show up at the accommodation (2:00 PM) without prior notification of the delay (it is possible to arrive until 6:00 PM but must be announced), will incur a cancellation/no-show fee, representing the equivalent of the first night of accommodation. Rates resulting from changes may vary, depending on the nature of the change, as well as availability at the time of the change made to the reservations. RETURN OF PAID AMOUNTS If the reservation is canceled or modified up to 48 hours before the date of arrival, the amount paid will be refunded in full. If the reservation is canceled or modified later or in case of no-show without prior notification of the delay, the amount paid will be partially refunded, less the value of the first night of accommodation. The amounts will be returned to the account you mentioned in the email sent to our email address office@hotels-eden.ro, within a maximum of 15 days from its receipt, except for online payments in which the return will be made to the card account from which it was initially collected. All such links and applications, including but not limited to those of content providers, merchants, franchisors, business partners, hereinafter referred to as “Providers”, have terms and conditions different from these. The User agrees that the Parties are not responsible in any way for injury, loss or damage to the computer or data, documents or information on the User's computer or for the interception or use of credit card information, related to or resulting from the use of the site or any linked or connected sites, services or materials and are also not responsible in any way for injury, loss, claim or damage related to or resulting from any part of the site that operates or does not operate on computers or networks used by the User or communicating with such computers or networks. We reserve the right to cancel or modify reservations when it is proven that a customer is engaged in fraudulent or inappropriate activities or in circumstances from which it appears that the reservation contains or results from a mistake or error. APPLICABLE LAW AND LITIGATIONS The rights and obligations of the parties provided for by these TERMS AND CONDITIONS, as well as all legal effects they produce, will be interpreted and governed in accordance with the Romanian legislation in force. All disputes arising from or in connection with the provision of services that form the subject matter of these TERMS AND CONDITIONS will be resolved by the competent Romanian courts at the headquarters of SC Center Care Suceava SRL.
